Addressing Concerns About My Images

Hello fans!
         It has been quite a while since I have made a blog post about my photography. I intend on making it a new practice, with posting a "review" of my session along with a collage of portraits from that day. But before I do that, I need to address a few concerns, and possibly a new rule that "could" be implemented soon. This is a little long, but PLEASE read it, there is some very important information in here.


I'm talking about copyright. Everyone knows what copyright is.. right? Not exactly. As I am learning right now, copyright isn't widely believed in. In the laws it states that : "The Copyright Act protects photographers by giving the author (creator) of the photograph the exclusive right to copy, edit, and distribute image by sale or transfer. These exclusive rights make it illegal to copy, scan, or edit, or share photographic prints and digital media without the photographer’s permission. Violators of this Federal Law will be subject to its civil and criminal penalties.” So that's enough right? No, its not. That is why in both my contracts, the wedding, portrait and printing DVD/CD, and also my facebook page i have stated : "you MAY NOT copy, alter or reproduce these images in any way" or "without written permission". I am noticing my images popping up on facebook that are DRASTICALLY different from the digital image i had provided to my client. I am also noticing that unlike my contract states it is REQUIRED, there is no image credit for my work.


Here are a few guidelines of the Do's and Don't of stealing images:
If I keep going, I will probably mess up the total intent of this post, so below is great verbiage from the fabulous Drew B of the Momtog Blog. Drew is an awesome wedding photographer down in Orange County and also started the Momtog blog for Mom’s who want to learn more about getting great images of their kiddos.
“I get asked a lot by both photographers and clients what my policy is on letting my clients post their images to their blogs and facebook account. I personally love it when my clients post their family pictures on their blogs, facebook, etc. It shows me that they truly love their images! I encourage my clients to “steal” their pictures from my blog to use on the internet. Here are a few do’s and don’ts that you should think about when reposting your images:
1) DO ask your photographer what their specific policy is on taking pictures off of their blogs. Some photographers encourage it and some don’t allow it. If this is important to you this is something you should ask BEFORE you hire your photographer!
2) DO include your photographer’s name and website under the images (a link would be super nice!). That’s just the polite thing to do:) (in my case it is required)
3) DON’T crop out their logo. Unless you have paid for the digital negatives don’t alter the files in anyway. Most photographers use their blogs to advertise their work and do so as a courtesy to give their clients a sneak peek. If a client crops out the logo then how will other people know who took the picture?
4) DON’T edit the picture in any way. Taking the pictures is only half of a photographer’s job. The other half is editing. If you think you can do a better job or want to edit out some of your wrinkles or use selective coloring please don’t show and/or tell your photographer. That is super insulting. If you don’t like your photographers editing enough to want to edit it yourself than maybe you need to find another photographer next year. (In my case, I find this personally insulting. I spend a lot of time on my clients photos to make sure they are the best that they can receive. If you are unhappy with a photo, please let me know and I will edit that photo again.)
5) DON’T try to print from the files on the blog. For me specifically I know that the files I upload to my blog are too small to be printed in a 4×6 size. It’s not cool to invest in a family session and then print the images off of the blog and not pay for prints. Make sure you know how much the prints cost before the session to avoid sticker shock. Same goes for scanning prints that you already bought. Not cool! Some of my family members are guilty of printing images off of my blog. It makes me cringe when I see them FRAMED in their homes with my logo still on there!”
 
 I will be informing those today that have breached my contract. You will have 24 hours to comply with my terms, or I will be mailing you a bill for $300.00 per image, per use, as it is stated in my contract for penalty of misuse. I am sorry that it has come to this. But I refuse to have my work shown in less quality than it is given. If matters cannot be dealt with in an adult like manner, I will no longer be providing a DVD or CD copy. This truly saddens me.

Want to help local fire victims in need?? Then check out our new program!!

I was sitting in my home a few days ago talking with my husband about all the recent fires that are leaving people out of their homes with very little or nothing at all , and upon reading and acting for a fellow facebook friend (sortof-friend!), I got to thinking. What if it were as easy as getting a photo taken to help one of those families? Especially when to those families, every dollar counts. And so, my new promotion was born. Please read the following:

- K Brobst Photography is teaming up with the facebook page Schuylkill County Fire Companies and we are supporting the families of local fire victims who are feeling the wrath of mother nature. Most families that have a fire in their home end up with very little to nothing left, including money to pay for new accomodations! So, when you book a portrait session with us, we will immediately take 20% off the total amount you have paid, and give that directly to a family in need. We can't think of a better way to help someone, short of just giving them money straight out of my pocket! (Which I have also done!)

So, if you know of anyone, or are someone, who has been a victim of a fire and need help, please email us and let us know so we may add you to our list of families in need!
